Son of ‘OC Housewife’ charged in shooting ordered back to county lockup - East Bay Times

An Orange County Superior Court judge on Friday temporarily stopped Santa Ana City Jail officials from moving the son of a former “Real Housewives of Orange County” cast member back to county lockup, where he says he was targeted for violence while behind bars.

The less than two-month-old agreement between the city and county jails regarding the housing of Josh Waring appears to have quickly fallen apart, leading Waring’s attorney to allege that moving his client back to a county jail facility could leave him open to retaliation by deputies or fellow inmates.

Waring, the son of celebrity personality Lauri Peterson, is awaiting trial related to the shooting of a man outside a sober living home in 2016. Waring has denied playing any role in the shooting, and as part of Waring’s case, his attorney, Joel Garson, learned that at least 34,000 recordings of attorney-client calls – which are supposed to be confidential – were made by the jail’s phone vendor.

Waring and his attorney contend that since the jail call revelations deputies have retaliated by setting Waring up for attacks by other inmates in county jail. The Orange County District Attorney’s Office has confirmed it is looking into several incidents in the county jails, including the pepper spraying by deputies into a jail holding facility housing Waring and a violent attack on Waring by another inmate.

The alleged attacks led Garson to request a judge either lower Waring’s $1 million bail or release him on his own recognizance pending trial, with the defense attorney arguing that deputies have been either unwilling or unable to protect Waring.

The agreement to move Waring from county lockup to the Santa Ana City jail was meant to address his safety concerns. But Waring’s attorney told Orange County Superior Court Judge Jonathan Fish that Waring has been kept in solitary confinement for his entire time at the city jail and hasn’t received the medical care he needs.

The judge noted that keeping Waring separate from other inmates was necessary to keep him safe. Garson acknowledged that is true, but said Waring is still entitled to at least some time out of his cell.

Attorneys representing the county and Santa Ana city jails argued that the agreement to house Waring was tied to a contract between the two agencies, and that Waring did not have the standing to challenge the move in court.

Fish set a Feb. 4 hearing date to discuss whether Waring or his attorney could stop the move from city to county lockup. In the meantime, the judge ordered that Waring remain at the Santa Ana City Jail.

After Friday’s hearing, Garson said he believed officials with the Santa Ana City Jail decided to end their agreement to hold Waring after he began filing grievances challenging his lack of time outside his cell.

“They are tired of him asserting his rights,” Garson said.

A trial date for Waring’s criminal case has not been set.
